You have the right to a safe workplace. The Occupational Safety and Health Act of 1970 (OSHA) was passed to prevent workers from being killed or seriously harmed at work. The law requires employers to provide their employees with working conditions that are free of known dangers. OSHA prohibits any employer from discriminating against workers for exercising their rights to safe workplace covered under the Act.

Shipyard work is traditionally hazardous, with an injury-accident rate more than twice that of construction and general industry. OSHA has targeted the industry in its Strategic Plan to reduce injuries and illnesses and prevent fatalities.

It is critical that you protect yourself at work by identifying potential hazards before they occur. This includes working around unsafe loads, improperly ventilated areas, working around cranes and machinery, slips / falls / tripping obstacles, properly maintained safety equipment, and properly trained to use safety equipment and tools. It is up to you and your co-workers to identify and demand a safe workplace. You must begin documenting potential hazards and then let’s discuss how you might correct any potential problems.

 Document the Facts:

1. Describe briefly the hazard(s) you believe exist
2. Number of employees exposed or threatened
3. Specify building and worksite where violation exists
4. How and when are workers exposed
5. What type of equipment is used? Is it in good condition?
6. Have employees been informed or trained regarding hazardous conditions?
7. How long (to your knowledge) has the condition existed?
8. Have any attempts been made to correct the problem?
9. Has anyone been injured or made ill because of this problem?
10. Have there been any “near miss” incidents?
